In 2014, the Namibia Airports Company (NAC) entered into a written agreement with the appellant, Menzies Aviation (Namibia) (Pty) Ltd (Menzies) to perform ‘ground handling services’ at the Hosea Kutako Internationa Airport (HKIA). The agreement was to be for an initial period of five years commencing on 1 January 2014. It had a renewal period of another three years which was implemented leading to a termination date of 31 December 2021.
